If he’d brought his underwear maybe he would have stayed out of jail.

A 21-year-old Somerville man was arrested Saturday morning at the Holiday Inn after he refused to leave his raucous birthday party and insisted to try and go back to get his underwear, police said.

Peter Tsirigotis, of 37 Columbus Ave., spit on a police officer after he was not allowed to go back inside the hotel for his underwear, police said.

Police initially arrived at the hotel and cleared the room out except for three people. Tsirigotis told officers “it was his birthday and he rented the room and wanted to know why his party was being broken up,” police said.

Tsirigotis, Kevin Armstrong, 22, of 33 Bow St., Erving Nazaire, 20, of Tewksbury, uttered profanity and complaints as they left the room. After Tsirigotis spit at an officer, Nazaire and Armstrong refused to leave the scene.

All three were arrested.

Tsirigotis was charged with disorderly conduct, assault and battery with a dangerous weapon and resisting arrest. Armstrong and Nazaire were arrested and charged with disorderly conduct.
