Privitera charged with negligent homicide

A prominent Somerville attorney and businessman will be arraigned on charges of negligent homicide one year after a fatal accident took the life of a Tufts University student.
   A clerk magistrate found probable cause to charge Francis D. Privitera in the death of Boryana Damyanova, 22. Damyanova was struck and killed Nov. 22, 2005 when she was crossing Broadway at Wallace Street near Powder House Square. She was struck by Privitera as he was driving west on Broadway at 6:20 p.m. at a well-lit crosswalk, said Capt. Paul Upton of the Somerville Police Department.

  Once hit, Damyanova was thrown to the other side of the street and struck by a truck traveling east, driven by Gina Furtado of Medford. Damyanova was pronounced dead that night at Somerville Hospital at 7:20 p.m.
  Damyanova had come to the United States from Bulgaria to study International Relations at Tufts. She was buried in her home country the first weekend of December 2005.
  Only Privitera is being cited for Damyanova’s death. Speed and alcohol are not considered to be factors, police said. State Police took over the investigation because Privitera’s son-in-law, Mike Kennelly, is a Somerville Police officer.
  Privitera will be arraigned in Somerville District Court at a date to be determined.
  Privitera owns land throughout Somerville, including a building just a short distance from where the deadly accident took place.
