Somerville man arraigned in connection with fatal crash

A Somerville man has been arraigned on charges in connection with a motor vehicle crash that resulted in the death of Sinead Lovett, 29, of Braintree, Middlesex District Attorney Gerry Leone informed the public last week.
Richard Migliacci, 37, of Somerville, was arraigned today in Middlesex Superior Court in Woburn on charges of felony motor vehicle homicide and operating a motor vehicle with a suspended license. Middlesex Superior Court Clerk Magistrate Matthew Day ordered Migliacci held on $10,000 cash bail with the conditions that he undergo a substance abuse evaluation, refrain from the use of drugs and alcohol, and submit to random alcohol tests. Migliacci was then held without bail on a probation detainer issued out of Cambridge District Court.


His next court date is on March 22 for a pretrial conference.
According to authorities, on July 9, 2010, at approximately 9:10 p.m., Somerville Police responded to Mystic Avenue at Route 28 south for reports of a single motorcycle crash. Upon arrival police observed Lovett lying on a center median. She was unresponsive and had significant visible injuries. Officers also observed Migliacci allegedly walking his motorcycle away from the scene of the crash. The victim and the defendant were both immediately transported to Massachusetts General Hospital. Lovett was pronounced dead shortly after she arrived at the hospital.
Massachusetts State Police reconstruction team immediately began an investigation into the circumstances of the crash. Authorities allege that Migliacci was operating the motorcycle with the victim in the passenger’s seat behind him. It is alleged that the defendant ran a red light on Route 28 near Wellington circle and proceeded to travel at a high rate of speed while weaving between traffic lanes. Authorities allege that he then cutoff an oil tanker on Route 28 south near Interstate 93 south and subsequently struck a center median. The collision with the median resulted in the victim being thrown from the motorcycle. A subsequent analysis of Migliacci’s blood alcohol level determined that it was nearly three times over the legal limit. Court records indicate that Migliacci was operating on a suspended license that was suspended for drug related matters.
This defendant was indicted by a Middlesex Grand Jury on February 3.
