Somerville Police officers were dispatched to Maya Sol Mexican Grill on Broadway last Sunday evening on reports of a man allegedly trying to pick fights with people inside the restaurant.
As the Somerville Police officers arrived on the scene, they observed a State Trooper walking the suspect, Victor Moya, of Everett, out the door of the establishment.
According to reports, Moya appeared to be in an agitated state. The officers told him that he was free to leave and that he was no longer welcome inside the restaurant due to his behavior.
Moya then reportedly took one step away, turned around, and began to walk towards the officers, who took a step back and used one of their arms to keep Moya at a safer distance.
An officer was forced to push Moya back twice while telling him to back up as he continued to advance towards him.
Moya reportedly stated that he was a big guy and smiled as he charged towards us. He continued to mumble and the officers were unable to distinguish what he was saying.
All of the patrons inside the restaurant had gathered at the front door and large windows. Cars which had stopped at the red light continued to sit even when the light had turned green.
Moya advanced towards the officer a third time and pushed past his outreached arm and forcefully chest bumped him, pushing him backwards.
The officer used his momentum and utilized an arm bar take down, and Moya was taken to the ground. Multiple nips of alcohol spilled out of Moya’s sweatshirt onto the sidewalk.
Moya tensed up his arms but the officers were able to handcuff him without incident, and he was advised that he was then now under arrest.
A transport unit was called to take Moya to headquarters for booking. While seated, Moya reportedly tried to slip out of the handcuffs and attempted to break them.
The officers questioned patrons and staff of Maya Sol, and many of the patrons said that they had never seen Moya before. On this evening he came inside and was trying to fight multiple people, including an older gentleman who appeared distraught but did not wish to talk to the officers.
Moya was subsequently booked on charges of assault and battery on a police officer and disorderly conduct.
